The United States Court of Appeals for the Tenth Circuit, Office of the Clerk, has sent a letter reminding the individual wishing to appeal the order denying him the right to intervene in the SCO v.

SCO filed a motion asking for more time to file its appeal brief with the Tenth Circuit Court of Appeals. They needed 10 more days, and Novell agreed to it, so the clerk signed off on it the same day the motion was filed, and the new date for SCO to file its brief will be September 9.

We have at last Novell's appeal brief [PDF] in the private antitrust case Novell brought against Microsoft regarding WordPerfect. The brief was filed with the US Court of Appeals for the Fourth Circuit. It begins: "This case has been here before." Indeed. Here's the decision from the US District Court in Maryland that Novell is appealing, as text. But there's more.

Novell has filed its brief in the appeal of SCO v. Novell. It's 87 pages, so I haven't read it yet myself. I'll swing back by after I read it. But the quick look at the index and the closing words indicates Novell is asking the court to affirm the lower court: "For all the above reasons, the district court judgment should be affirmed."

Judge Tena Campbell has today ruled against SCO, who had asked to go forward against IBM in SCO v. IBM, without letting IBM go forward on its most significant claims. "The court declines," her order says, to reopen anything now, because too much depends on what happens in SCO v. Novell, and it doesn't make sense to divide the two cases.

A US federal appeals court overturned a judge’s ruling that granted Novell the copyright of the Unix computer OS yesterday. A panel of three judges of the 10th US circuit Court of Appeals ruled that a judge in the August 2007 case wrongfully handed the copyright to Novell. As a result the panel has ordered a “remand for trial” to establish ownership.

On my first day of my new position as civil liberties director at the Electronic Frontier Foundation, the U.S. 10th Circuit Court of Appeals dealt my previous employer, the Stanford Center for Internet and Society, a fantastic victory. The court's ruling in Golan v. Gonzales is also a triumph for the First Amendment and for the overwhelming majority of creators.
