Novell has filed its brief in the appeal of SCO v. Novell. It's 87 pages, so I haven't read it yet myself. I'll swing back by after I read it. But the quick look at the index and the closing words indicates Novell is asking the court to affirm the lower court: "For all the above reasons, the district court judgment should be affirmed."

We have at last Novell's appeal brief [PDF] in the private antitrust case Novell brought against Microsoft regarding WordPerfect. The brief was filed with the US Court of Appeals for the Fourth Circuit. It begins: "This case has been here before." Indeed. Here's the decision from the US District Court in Maryland that Novell is appealing, as text. But there's more.

The United States Court of Appeals for the Tenth Circuit, Office of the Clerk, has sent a letter reminding the individual wishing to appeal the order denying him the right to intervene in the SCO v.

I don't have details yet, but here's the first report from today's bankruptcy court hearing on SCO's motion to extend its exclusive right to file a reorganization plan, which Novell had filed objections to:

SCO has now filed its appeal brief with the 10th Circuit Court of Appeals. This is the second time SCO has appealed a loss in the US District Court in Utah to this appeals court.

Novell wants the US Supreme Court to review its seemingly-never-ending legal tete-a-tete with SCO over the famous UNIX and UNIXware copyrights. As noticed by Groklaw, Novell has filed a motion with a federal appeals court asking for a 90-day stay in the SCO case so it can file a writ of certori petition with the Supremes.

They played videos in court today, day 4 of SCO v. Novell's jury trial. SCO claims it has a surprise witness, like that surprises anyone that has been following SCO's legal ways. There was a dispute about that, but I gather it will happen eventually.

There is a hearing coming up on February 4 at 3 PM before Judge Stewart in SCO v. Novell, and I surely hope some of you can attend, regarding Novell's recently filed motion asking to set aside an earlier judgment by Judge Kimball, so Novell can go after monies SCO took in from Microsoft and companies that bought a SCOsource license. But there's something odd in the notice about the hearing.

We finally have the transcript from the court for the January 23, 2007 hearing in SCO v. Novell. This is the hearing on Novell's motion about the money, on the question of whether SCO owes Novell for the money it took in from Sun and Microsoft in 2003, or as I call it Novell's "give us our money before it's all gone" motion.
