U.S. innovation slowed this year for the first time in 13 years as the recession cut into budgets, and costs to protect inventions rose. The system is broken.. Pushing patents through the system is easier said than done: The decline in filings this year has brought to light a number of problems with the antiquated American patent system.

IP Innovation LLC has just filed a patent infringement claim against Red Hat and Novell. It was filed October 9, case no. 2:2007cv00447, IP Innovation, LLC et al v. Red Hat Inc. et al, in Texas. Where else? The patent troll magnet state. And now let's play, where's Microsoft?

Red Hat could use our help finding prior art in connection with the patent infringement litigation brought by IP Innovation, LLC, a subsidiary of Acacia against Red Hat and Novell.

The Novell/Canopy/Caldera/DR DOS story continues, and Novell and Microsoft are in the middle of it all, battling in discovery in the Novell v. Microsoft antitrust litigation -- that is the litigation over WordPerfect currently before the US District Court in Maryland in pretrial discovery.

Let's continue with our look at the trial testimony in the SCO v. Novell litigation. This is day 2, April 30, when our star witness of the day is Darl McBride. That day, the Chris Sontag testimony had finished up, which I've shown you already, and after him, Novell called Darl to the stand. After him, there were two other witnesses but we'll look at their testimony separately.

When you're driving down the highway and you see a spotless white tanker truck with a big green tree painted on the side, you can be pretty sure that it's full of hazardous waste. Likewise, companies with "innovation" in their names are generally innovation-hostile patent trolls.
