Four months after being announced, the End Software Patents project (ESP) is launching a new Web site with arguments for economists, computer scientists, lawyers, and lay people about why they should support the project. Prominent on the site is the publication of a report on the state of patents in the United States during 2006-07, and a scholarship contest that will award $10,000 for "for the best paper on the effects of the patentability of software and business methods under US law."

The Bilski decision is out and it's a big step for eliminators of software patents

Patents on computer programs, financial processes and business methods have been controversial at least since the 1960s. Surveys regularly find that computer programmers are opposed to patents on software by a wide margin. In what other field is the class of inventors so opposed to patents?

The $250 million Vonage burned through as a result of the patent lawsuit brought by Verizon et al provides yet another example of why patents for business processes implemented on computers (a.k.a. software patents) deserve to die. Verizon’s two successful “name translation” patents negate an open standard assembled by Cisco, Microsoft, IBM, Intel and Vocaltec via the VoIP Forum during 1996.

The pending US Supreme Court decision regarding In re Bernard L. Bilski and Rand A. Warsaw v. Kappos, in principle about patents on business methods and software, has lead to briefs being filed by numerous companies and associations.

Patent advocates, large successful businesses, and politicians are so enthusiastic about the patenting of software that it’s hard to accept arguments from people like the FFII and Free Software Foundation who claim that the software industry simply does not need software patents and would be far better off without them.
