"End Software Patents, a project working toward the elimination of software patents, was launched today. The ESP project will initially focus on two approaches: 1) assisting corporations that choose to challenge software patents in the courts and at the U.S. Patent and Trademark Office (USPTO) on the basis that patents for software and designs with no physically innovative step have no legal validity, and 2) public education aimed at passing laws to protect software from patent law. [...] In a separate announcement today, ESP released its first report on the current state of software and business method patents. The report covers the economic impact of software patents, including the $11.4 billion that U.S. businesses waste each year on software patent litigation.

"End Software Patents (ESP) has filed an amicus curiae brief in the Court of Appeals for the Federal Circuit's (CAFC) rehearing of the In re Bilski case. The rehearing could lead to the elimination of patents on software.

The judiciary (the national courts) usually declares the EPO's software patents to be invalid whenever there is a court case. .."

Under new leadership, the US Patent and Trademark Office has begun to publish data on how long does it really takes to get a final answer on whether you will receive a patent. Answer, six years. The backlog of patents is almost 730 000.

Perhaps this will be the beginning of a patents reform?

Microsoft was awarded more than 1,600 patents by the U.S. Patent and Trademark Office (USPTO) in 2007, placing it sixth on the list of biggest patent performers, according to IFI Patent Intelligence, which tracks patent awards. IBM, which tried but failed to patent outsourcing last year, won the patent count for the 16th straight year, with more than 3,100 patents.

Everybody's suing everybody! ... None of the major companies really seem to take patents seriously. ... And why should they take patents serious? The United States Patent and Trademark Office grants patents for vague ideas, obvious processes and usage models and even the most mundane software user interface conventions.

Life is never easy for an open source evangelist. The OOXML drama came to a close on 2nd April 2008 and we were on to our next issue -- software patents. The Draft Patent Manual might end up bringing software patents through the back door. this would be surprising because the Indian parliament explicitly rejected software patents in the Patent Amendment Act 2005.

Open-source and free software fans who despise software patents shouldn't look for an ally in the head of the U.S. Patent and Trademark Office. Patent Commissioner Jon Dudas says his office is all about staying "technology neutral," so long as the invention meets certain standards.

Today Oracle sued Google over Java patents and copyrights that they claim Google's Android OS infringes. The lawsuit claims that Google knowingly infringed on those patents, and that the continued distribution of Google's Android is harming Oracle's Java Business.
