By rights, copyright really shouldn’t apply to binary executables, because they are purely “functional” (not “expressive”) works. The decision to extend copyright to binaries was an economically-motivated anomaly, and that choice has some counter-intuitive and detrimental side-effects.

The thing is that binary files are also an "expressive" work..
They are instructions made of 0s and 1s.. the procedure you make to obtain the mix of 10101110 binary commands and information doesn't change this.
You can create a painting with the eyes closed and aided by some tool, but the resulting painting is still your work.
