The Swiss News Agency (SDA) reported on Thursday, 28 May, that the Swiss Federal Administrative Court had issued an immediately enforceable ruling ("Superprovisorische Verfügung") that stops the award of a large federal government order to Microsoft.

Recently the Dutch government adopted a plan called - translated - 'Netherlands Open in Connection' * which describes how the system of tenders should be changed to migrate to open source software and software conforming to open standards. However, the very same Department of Finance that wrote this plan - because the parliament asked for it - has written a 'closed' document covered under copyright for a closed tender which is called 'GOUD' (Gold). For a large part, the tender indirectly only allows Microsoft software it seems**. Last time there was a closed tender, Microsoft was awarded a deal of €156M worth of software and Michael Robertson's Linspire €6M alternative was not even considered***.

Many open source licences are only two or three paragraphs long and read more like a manifesto than a traditional software licence.

Hungary's public administrations will by default use open document standards for their electronic documents, as of April this year, the government ministers agreed on 23 December, and all public organisations are encouraged to move to open source office tools. Hungary's government also in December decided to cancel the funding of proprietary office suite licences for all schools.

The hidden exit costs imposed by a previous software acquisition are a major reason for public administrations to tender software by naming brand names or specific products, which may be illegal, says a draft report by the European Commission's Open Source Observatory and Repository project (OSOR).

Today, Red Hat took a public stand challenging the standards for patenting software. In the Biliski case that is now before the Federal Circuit Court of Appeals, this patent issue is ripe for consideration.

A company called Savoir-Faire Linux, Inc. has filed in the Superior Court of Quebec against the government's pension plan for choosing Microsoft software without putting the job out publicly for bid. It seems the law in Quebec is very strict that the government is supposed to publish an invitation to tender for any acquisition of more than $25,000, and this job was a good deal more than that.

The Hungarian government will issue a tender within days for 12 billion forints, which is the same amount they can spend on Microsoft products, to acquire open source software.
